The short version
- Your footage
- You keep the rights to what you upload and own the edits we make for you. We use them only to run the Service for you.
- Your plan
- Creator is five videos a month and Professional is ten, after a 7-day free trial that includes one, at the monthly price shown in your studio and at checkout. Your plan renews monthly until you cancel.
- Cancelling
- Cancel any time from Manage billing. Cancel during the trial and you pay nothing. After that, your plan runs to the end of the month you’ve paid for.
- Your part
- Upload only recordings you have the right to use, and review every edit before you publish it.
This summary is for convenience. The full terms below are what apply.
01Agreement
These Terms of Service (“Terms”) are an agreement between you and AquaEdits, Inc., a Delaware corporation (“AquaEdits”, “we”, “us”). They cover the AquaEdits website, the AquaEdits studio, and the editing we provide through them (together, the “Service”).
By creating an account, starting a trial, or otherwise using the Service, you agree to these Terms. Our Privacy Policy explains how we handle your information. If you don’t agree to these Terms, don’t use the Service.
If you use the Service for a company or other organization, you confirm that you can accept these Terms on its behalf, and “you” includes that organization. If we sign a separate written agreement with you, such as an Enterprise agreement, that agreement controls where it conflicts with these Terms.
02Your account
- You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account or subscribe.
- Give us accurate information and keep it up to date. You sign in through our authentication provider, Clerk. Keep your sign-in methods secure. You’re responsible for activity under your account, and you should tell us right away at help@aquaedits.com if you think someone has used it without permission.
- Each account is for one person. Don’t share, sell, or transfer your account, and don’t create extra accounts to get more free trials or credits.
03The Service
AquaEdits is an AI video editor for long-form gaming videos. You upload a stream recording, choose the section to edit, and describe the video you want. Our automated systems analyze the footage and deliver an edit, currently as an editable project: a cut timeline for Premiere Pro or DaVinci Resolve with your source media and audio. The formats available to your account are shown in the studio.
Edits are made by automated systems, including AI models, and can contain mistakes. An edit may miss context, cut something you wanted, mishear speech, or misjudge what matters. Review each edit before you publish it. We don’t promise any particular creative result, audience response, views, or revenue.
These limits currently apply:
- Uploads can be MP4, MOV, MKV, WebM, M4V, or AVI files of up to 50 GiB, with both video and audio.
- Each edit covers a section of up to five hours of source footage.
- Each account can hold up to 20 uploads and 100 GiB of uploaded footage.
Processing time depends on your footage and on demand, and isn’t guaranteed. We may change, add, or remove features and limits. If a change significantly reduces what your paid plan includes, we’ll tell you before it takes effect.
04Plans, trials, and billing
Creator and Professional
Creator includes five videos per billing period, and Professional includes ten. Each plan’s monthly price, in US dollars, is the one shown in your studio and at checkout when you subscribe, and it’s never more than our listed price. We may offer different prices to different customers; the price you subscribed at is the one you’re charged. Each accepted edit uses one video credit and covers a source section of up to five hours. Unused credits don’t roll over. If we’re required to collect sales tax or a similar tax, we’ll add it at checkout.
Free trial
A new billing account can start a 7-day free trial that includes one video. A card is required, and nothing is charged during the trial. Unless you cancel before the trial ends, the plan you chose starts automatically and your card is charged your monthly price. Each billing account gets one trial: an account that has had a subscription before starts on the paid plan. Choosing Start Creator now or Start Professional now ends your trial early, charges your monthly price right away, and unlocks your monthly videos.
Renewal and payment
Your plan renews automatically every month. Your payment method is charged your monthly price at the start of each billing period until you cancel. Stripe processes our payments. By subscribing, you authorize us to charge your payment method through Stripe for each billing period. If a payment fails, new edits pause until it succeeds, and we may end the subscription if payment can’t be collected.
Cancelling
You can cancel at any time in the studio: open Plan & billing and choose Manage billing. If you cancel during the free trial, you won’t be charged. Otherwise, cancellation takes effect at the end of the current billing period, and you can use your remaining credits until then. Your previous edits stay available to download after you cancel, as described in our Privacy Policy.
Refunds
Fees are charged in advance for each billing period and aren’t refundable, including for unused credits and partial months, except where the law requires a refund. If an edit fails to process, its credit returns to the billing period it came from. A completed edit uses its credit whether or not you use the result. If you think you were charged in error, contact us.
Price changes
We’ll give you at least 30 days’ notice before a price change applies to your subscription. The new price takes effect at your first renewal after the notice period, and you can cancel before then.
Enterprise
Enterprise volume, scope, and pricing are agreed with you separately.
05Your content
“Your Content” means the recordings you upload, the details you give us about them (such as names, notes, sections, and target lengths), and everything we produce from them for you, including transcripts, timelines, project files, and exports (“Outputs”).
- You keep your rights. You keep all the rights you have in your uploads. As between you and AquaEdits, you own the Outputs, subject to any rights others have in the underlying material. We don’t claim ownership of Your Content.
- Our permission to process it. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transcode, analyze, transcribe, and modify Your Content, and to send it to the service providers listed in our Privacy Policy, only as needed to provide, secure, and support the Service for you. This license ends when Your Content is deleted from our systems, except for copies we must keep to comply with the law and copies in backups until they expire.
- We don’t sell it or train on it. We don’t sell Your Content or use it to train AI models. The service providers that process it for us handle it under their own terms.
- Keep your originals. The Service isn’t a backup service. Keep your own copies of your recordings and of any Outputs you want to keep.
06Acceptable use
You’re responsible for Your Content and for how you use the Outputs. Only upload recordings you own or have permission to use. Streams often include game footage, music, and other people’s voices and likenesses. Make sure you have the rights you need to edit and publish them, and follow the rules of the platforms where you post.
Don’t use the Service to:
- upload or create anything illegal, anything that infringes someone else’s rights, or any content that sexually exploits or endangers children;
- harass, threaten, or defame anyone, or share someone’s private information without their permission;
- upload malware, or interfere with, disrupt, or overload the Service;
- probe or test the Service’s security, or get around its limits, credits, access controls, or trial rules;
- copy, reverse engineer, or resell the Service, or access it by automated means other than the ones we provide, except where the law allows it despite this restriction.
We may remove content, pause edits, or suspend accounts that we reasonably believe break these rules or the law, and we may report illegal content to the authorities.
Copyright complaints
If you believe material in the Service infringes your copyright, email help@aquaedits.com with your contact details, a description of the work, enough information for us to find the material, a statement that you believe in good faith that the use isn’t authorized, a statement under penalty of perjury that your notice is accurate and that you own the copyright or are authorized to act for its owner, and your physical or electronic signature. We may remove the material, and we end the accounts of repeat infringers where appropriate.
07Our service and third parties
The Service, including its software, design, and the AquaEdits name and logo, belongs to AquaEdits, Inc. and its licensors. While you follow these Terms, we give you a personal, non-exclusive, non-transferable right to use the Service. If you send us feedback or suggestions, we may use them without any obligation to you.
Parts of the Service rely on third parties, including Clerk for sign-in and Stripe for payments, and Outputs are made for third-party editors such as Premiere Pro and DaVinci Resolve. Their own terms apply to your use of their products, and we aren’t responsible for them. We can’t guarantee that every version of an editor will open every project.
08Suspension and termination
You can stop using the Service at any time. Cancel your subscription from Manage billing. To close your account and delete its data, email help@aquaedits.com from the address on your account.
We may suspend or end your access if you seriously or repeatedly break these Terms, don’t pay, put the Service or other people at risk, or if the law requires it. Where it’s reasonable, we’ll tell you first and give you a chance to download your Outputs.
If we stop offering the Service, we’ll give you at least 30 days’ notice and refund any prepaid fees for the time after it ends.
The sections on your content, disclaimers, limitation of liability, indemnity, and disputes, and any other terms that by their nature should continue, survive after these Terms end.
09Disclaimers
The Service and Outputs are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don’t warrant that the Service will be uninterrupted, secure, or error-free, or that any Output will be accurate or meet your needs.
Some jurisdictions don’t allow these disclaimers, so some of them may not apply to you.
10Limitation of liability
To the fullest extent the law allows, AquaEdits, Inc. and its officers, employees, and suppliers won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service or these Terms. Our total liability for all claims relating to the Service or these Terms is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or US$100.
These limits apply whatever the legal theory, even if we were told such damages were possible. They don’t apply where the law doesn’t allow them.
11Indemnity
You’ll defend and indemnify AquaEdits, Inc. against third-party claims, and the related losses and reasonable legal fees, arising from Your Content, your use of the Outputs, or your breach of these Terms or the law. We’ll tell you promptly about any such claim.
12Disputes and governing law
If you have a concern, email us first at help@aquaedits.com. We’ll try to resolve it informally, and we both agree to try for at least 30 days before starting a formal proceeding.
These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law rules. Any legal proceeding about the Service or these Terms must be brought in the state or federal courts located in Delaware, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small-claims court.
If you’re a consumer, you also keep any protections, including any right to bring claims in your local courts, that the law where you live gives you and that can’t be waived by contract.
13Changes to these Terms
We may update these Terms. We’ll post the new version on this page and change the date at the top. If a change materially affects your rights or obligations, we’ll tell you by email or in the studio at least 30 days before it takes effect, unless the change is required by law or addresses security or abuse. If you keep using the Service after a change takes effect, the updated Terms apply. If you don’t agree to them, cancel before then.
14General
- These Terms, the Privacy Policy, and any separate agreement we sign with you are the entire agreement between you and us about the Service.
- If a court finds part of these Terms unenforceable, the rest still applies. If we don’t enforce a term right away, we haven’t waived it.
- You can’t transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition, or sale of assets.
- We send notices to the email address on your account. Send notices to us at help@aquaedits.com.
- Neither of us is responsible for delays caused by events beyond our reasonable control.
